Vive Communications, LLC (“VIVE COMMUNICATIONS”) appreciates your visit to this web site (“Site”). The following rules and regulations apply to all visitors or users of the Site. For purposes of accessing and browsing this Site, you accept, without limitation or qualification, these terms and provisions and acknowledge that, with regard to your access to or use of this Site, no other agreements between you and VIVE COMMUNICATIONS are of any force or effect. These rules and regulations apply to all visits to the Site, both now and in the future.

Compliance with Applicable Laws; Export Control Laws

The user’s access to this Site is governed by all applicable federal, state, and local laws. All information available on the Site is subject to U.S. Export Control laws and may also be subject to the laws of the country where you reside.

Trademarks

The trademarks, service marks, and logos (“Marks”) displayed on this Site are the property of VIVE COMMUNICATIONS or are used with the permission of the appropriate third party. Users are not permitted to use these Marks without the prior written consent of VIVE COMMUNICATIONS or such third party that may own the Mark.

Information Provided to VIVE COMMUNICATIONS

VIVE COMMUNICATIONS does not want you to, and you should not, send any confidential or proprietary information to VIVE COMMUNICATIONS via the Site. Any submission by you to VIVE COMMUNICATIONS, including but not limited to questions, comments, suggestions, and the like shall be deemed to be non-confidential and shall become the property of VIVE COMMUNICATIONS. Furthermore, by your submission, you grant to VIVE COMMUNICATIONS an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit, and distribute such information. VIVE COMMUNICATIONS shall be free to use any ideas, concepts, know-how, or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products incorporating such information.

Notice and Ability to Opt-Out

When personal information is collected, we typically inform the individual at the point of collection or upon our first communication to the individual the purpose for the collection and where appropriate, allow the individual to elect whether to provide the information to Vive Communications and/or specify how we can use such personal information.

Vive Communications provides individuals who elect to receive electronic or other communications the ability to “opt-out” of those communications by sending us a notice to unsubscribe. Vive Communications respects your wishes and will discontinue communicating with individuals who have requested not to receive email or other communications from Vive Communications. This means we assume an individual has given us consent to collect and use his/her personal information in accordance with this Policy unless the individual has taken affirmative action to indicate that he/she does not consent, for instance by clicking or checking the appropriate option or box at the point of collection. In some cases, when applicable, Vive Communications will provide an individual with the opportunity to “opt-in.” This means that we will require affirmative action from the individual to indicate his/her consent before we use personal information for purposes other than the purpose for which the personal information was submitted.

Sharing, Disclosure and Security of Personal Information

If an individual chooses to provide Vive Communications with personal information, the personal information will be used solely by and transferred only to Vive Communications, its offices and subsidiaries around the world, its resellers and distributors and service providers, which are those companies contracted by Vive Communications to deliver requested information and services. We may also transfer personal information across borders and from the individual’s country or jurisdictions to Vive Communications’ offices and subsidiaries, its resellers and distributors and service providers around the world. All such entities are governed by this Policy or are bound by appropriate confidentiality agreements.

An individual’s personal information is typically not shared outside Vive Communications without permission, except under conditions explained below. Vive Communications may send personal information to other service provider companies under any of the following circumstances:

  • when we have an individual’s consent to share the information;
  • if sharing an individual’s information is necessary to provide a product or service that is requested (If personal information is shared with third parties we will only provide the information they need to deliver the service. Also, such companies are prohibited from using such personal information for any other purpose);
  • as part of a joint sales promotion or to pass sales leads to one of our distribution partners; and
  • to keep an individual up to date on the latest product announcements, product updates, special offers or other information we think he/she would like to hear about either from us or from our service providers (unless the individual has opted out of these types of communications).
  • We will also disclose personal information if required or permitted to do so by law, or in urgent circumstances, to protect personal safety, the public or our websites.

Vive Communications safeguards the security of the personal information and other data provided to us with physical, electronic and managerial procedures. Inside Vive Communications, data is stored in secure and controlled servers with limited access. Your information may be stored and processed in the United States or any other country where Vive Communications, its subsidiaries or service providers are located. While we strive to protect personal information, we cannot ensure the security of the personal information provided to us. Use of Cookies
